Frequently Asked Mortgage Questions

What is Title Insurance?

Title insurance is a contract, which indemnifies an owner of land against loss or damages from defects in title, subject to the terms of the policy.

What is the purpose of Title Insurance?

Many people often ask this question. The purpose of Title Insurance is to indemnify owners of land against loss suffered as a result of title being unmarketable. It also indemnifies owners against hidden defects in the title to real property.

The unmarketability of a title is a non-saleable title or a title with defects. The entire concept of insurance provides economic security, psychological security, indemnification, loss reduction and prevention. That's why title insurance is important to land owners.

How does it work?

An abstract of title is ordered, which is a condensed history of title showing who owns the property subject to liens.

A title search encompasses everything that may bear upon the title, such as records of deeds, grants and conveyances of wills, liens, encumbrances, easements, restrictions, right-of-way, taxes, water and sewer liens. The substantial potential financial loss to the purchaser or receiver of property defective in title is obvious, which brings the need for some form of title assurance.
